These Terms & Conditions govern purchases from and use of Black Dove Apparel’s website, online storefronts, products, services, designs, photographs, graphics, and other content.
By accessing our store, placing an order, or purchasing merchandise from Black Dove Apparel, you agree to these Terms & Conditions, together with our Shipping Policy and Refund, Return & Exchange Policy.
1. GENERAL TERMS
Black Dove Apparel reserves the right to update products, prices, descriptions, policies, promotions, and these Terms & Conditions when reasonably necessary.
We also reserve the right to refuse or cancel orders where reasonably necessary, including orders involving suspected fraud, unauthorized transactions, pricing or inventory errors, misuse of promotions, or other circumstances that prevent us from properly fulfilling an order.
If we cancel a paid order before fulfillment, any amount due back to the customer will be refunded as appropriate.
2. PRODUCT INFORMATION
We make reasonable efforts to accurately display and describe our merchandise.
Actual colors, placement, dimensions, print appearance, and other characteristics may vary slightly because of differences in garment manufacturing, printing processes, materials, photography, lighting, and electronic displays.
Minor production variations that do not materially affect the product are not necessarily defects.
3. SIZING
Customers are responsible for reviewing applicable sizing information before purchasing.
Sizing can vary between manufacturers, garment styles, and collections. An item not fitting as personally expected does not by itself constitute a manufacturing defect when the correct item and size ordered were supplied.
4. MADE-TO-ORDER & CUSTOM MERCHANDISE
Certain Black Dove Apparel merchandise may be printed, produced, customized, or otherwise prepared after an order is placed.
Once production begins, changes or cancellations may not be possible.
Eligibility for cancellation, return, exchange, or refund is governed by our Refund, Return & Exchange Policy and applicable law.
5. PRICING & ERRORS
Black Dove Apparel reserves the right to correct genuine typographical, pricing, product-description, promotional, inventory, or technical errors.
If an error materially affects an order that has already been submitted, we may contact the customer regarding available options or cancel the affected order and issue any refund that is due.
We will not intentionally misrepresent pricing or use this provision to avoid legitimate orders.
6. PAYMENT
Customers represent that they are authorized to use the payment method submitted with an order.
Orders may be subject to payment verification, fraud screening, or other reasonable security measures.
Providing false, fraudulent, stolen, or unauthorized payment information is prohibited.
7. FRAUDULENT ORDERS
Black Dove Apparel reserves the right to cancel, hold, investigate, or refuse orders reasonably suspected of fraud or unauthorized activity.
Where appropriate, relevant transaction information may be provided to payment processors, financial institutions, marketplaces, shipping carriers, or lawful authorities for fraud prevention, dispute resolution, or legal compliance.
8. CHARGEBACKS & PAYMENT DISPUTES
Customers are encouraged to contact Black Dove Apparel first regarding legitimate order problems so that we have an opportunity to investigate and resolve the issue.
Filing a payment dispute does not alter the underlying facts or records associated with an order.
When responding to a chargeback or payment dispute, Black Dove Apparel may provide relevant documentation to the applicable payment processor, marketplace, bank, or card issuer, including order confirmations, customer communications, shipping and tracking information, delivery confirmation, applicable policies, photographs, and production or fulfillment records.
Nothing in this section prevents a customer from exercising lawful rights to dispute an unauthorized or otherwise legitimately disputable transaction.
9. SHIPPING
Customers are responsible for providing complete and accurate shipping information.
Shipping estimates, delivery issues, incorrect addresses, lost packages, and other fulfillment matters are governed by the Black Dove Apparel Shipping Policy.
Where applicable law gives a customer cancellation or refund rights because an order cannot be shipped within the required or promised timeframe, those rights will be honored.
10. RETURNS & REFUNDS
Returns, exchanges, cancellations, damaged merchandise, incorrect merchandise, and refunds are governed by the Black Dove Apparel Refund, Return & Exchange Policy.
Nothing in these Terms eliminates consumer rights that cannot legally be waived.
INTELLECTUAL PROPERTY NOTICE
11. OWNERSHIP OF BLACK DOVE APPAREL CONTENT
Unless otherwise stated or lawfully licensed from another party, Black Dove Apparel’s original creative content including original artwork, graphics, designs, logos, branding elements, product photographs, written descriptions, slogans, promotional materials, website content, and other original materials is owned by or licensed to Black Dove Apparel and may be protected by applicable copyright, trademark, and other intellectual-property laws.
Purchasing a Black Dove Apparel product does not transfer ownership of the intellectual property embodied in the product.
12. NO UNAUTHORIZED REPRODUCTION
Black Dove Apparel’s original designs and content may not be copied, reproduced, traced, scanned, digitized, modified, distributed, republished, manufactured, sold, or commercially exploited without appropriate authorization.
This includes using our original artwork or designs to manufacture competing or unauthorized merchandise.
Nothing in this provision is intended to prohibit uses permitted by applicable law.
13. COMMERCIAL USE
Unless Black Dove Apparel provides express permission or a separate license, purchasing merchandise is for personal use and does not grant a license to reproduce Black Dove Apparel’s protected artwork or branding for commercial purposes.
14. THIRD-PARTY INTELLECTUAL PROPERTY
Third-party names, trademarks, artwork, imagery, or other intellectual property appearing in connection with our business remain the property of their respective owners where applicable.
Black Dove Apparel does not claim ownership of third-party intellectual property merely because it is referenced or lawfully used in connection with a product.
15. COPYRIGHT & INTELLECTUAL PROPERTY COMPLAINTS
Black Dove Apparel respects intellectual-property rights.
If you believe material offered or displayed by Black Dove Apparel infringes intellectual-property rights you own or are authorized to enforce, please contact us with sufficient information to identify the material, the rights claimed, and the basis for the complaint.
We may investigate legitimate notices and take appropriate action when warranted.
WEBSITE & BUSINESS PROTECTION
16. PROHIBITED USE
Customers and website visitors may not use Black Dove Apparel’s services to:
• Commit fraud or other unlawful activity
• Submit knowingly false payment information
• Attempt to interfere with website security or functionality
• Misuse promotional codes or offers
• Impersonate another individual
• Harvest or misuse customer or business information
• Infringe intellectual-property rights
• Use automated systems to improperly access, scrape, or disrupt our services where prohibited by law
17. THIRD-PARTY SERVICES
Black Dove Apparel may rely on third-party providers for services such as payment processing, website hosting, printing, fulfillment, shipping, and marketplace transactions.
Those services may also be subject to the provider’s applicable terms and policies.
18. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Black Dove Apparel will not be liable for indirect, incidental, special, or consequential damages arising from the use of our website or products where such liability may lawfully be limited.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
19. INDEMNIFICATION
To the extent permitted by applicable law, users agree to be responsible for losses, claims, or expenses resulting from their unlawful misuse of Black Dove Apparel’s services, violation of these Terms, or infringement of another person’s rights.
20. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be interpreted or limited to the extent legally permissible, and the remaining provisions will continue in effect.
21. NO WAIVER
Black Dove Apparel’s decision not to immediately enforce a provision of these Terms does not necessarily waive the right to enforce that provision later.
22. CHANGES TO THESE TERMS
Black Dove Apparel may periodically update these Terms & Conditions.
The version applicable to a transaction will generally be the version in effect when the applicable transaction occurred, except where a change is required by law.
23. GOVERNING LAW
To the extent permitted by applicable law, these Terms & Conditions will be governed by the laws applicable to Black Dove Apparel’s principal place of business, without eliminating any mandatory consumer protections that may apply to a customer based on their jurisdiction.
24. ENTIRE AGREEMENT
These Terms & Conditions, together with the applicable Shipping Policy, Refund, Return & Exchange Policy, Privacy Policy, and any product-specific terms disclosed before purchase, constitute the applicable terms governing purchases from Black Dove Apparel.

LEGAL NOTICE
Black Dove Apparel reserves all rights in its original intellectual property to the extent provided by law.
Unauthorized commercial reproduction, duplication, distribution, or sale of Black Dove Apparel’s protected original designs is prohibited.
Black Dove Apparel may take appropriate action to protect its intellectual property, business interests, customers, and brand when infringement, fraud, unauthorized transactions, or other unlawful activity is identified.
